<P><FONT color=black> 近日，有“中国导航电子地图第一案”之称的“道道通”状告凯立德电子地图侵权一案再起波澜。记者从有关方面了解到，继北京市海淀区人民法院一审判决“道道通”胜诉之后，佛山市中级人民法院受理的北京长地万方科技有限公司（系瑞图万方旗下子公司）起诉凯立德（362城市）版侵犯其知识产权的法律纠纷，也将于4月29-30号开庭审理。据消息灵通人士透露，日前法院已经冻结了凯立德和凯立德欣五百万元现金存款，而该案也有望在近期作出一审宣判。</FONT></P>
<P><FONT color=black> 2007年初，长地万方正式向在北京市海淀区人民法院起诉凯立德，理由是《凯立德全国导航电子地图（335城市）》涉嫌抄袭《“道道通”导航电子地图》，案件随后进入了长达一年的调查取证、审理过程。同年9月，长地万方又在广东佛山向佛山市中级人民法院提起诉讼，指凯立德《362城市》版地图产品也同样涉嫌抄袭“道道通”导航电子地图，将凯立德告上法庭。</FONT></P>
<P><FONT color=black> 今年2月，北京市海淀区人民法院对“道道通”状告“凯立德”一案作出了一审判决：被告凯立德、以及销售了装载有涉案侵权作品的导航仪的北京中微恒业商贸中心立即停止出版、销售和使用侵权的《335城市》，并在《中国测绘报》上公开刊登赔礼道歉声明，并赔偿原告所受到的经济损失及承担原告诉讼费用。国内多家媒体纷纷对这一消息进行了报道。</FONT></P>
<P><FONT color=black> 据记者了解，同样是在海淀区人民法院，同样是在2007年，北京四维公司亦因其电子地图著作权遭到凯立德公司侵犯，将后者告上了法庭，结果是法院裁定凯立德侵权成立。凯立德在一年内三次成为被告，目前已经两次败诉，因而本月底佛山中院的庭审结果倍受各方关注。</FONT></P>
<P><FONT color=black> 日前，记者就此事采访了瑞图万方的相关负责人。他表示，法院会再次做出公正的判决，让侵权者受到应得的法律制裁，而瑞图万方也将不遗余力地联合“道道通正版大联盟”、消费者和媒体的力量，将维护知识产权、促进GPS行业健康发展的行动进行到底。</FONT></P>
<P><FONT color=black> 据悉，这两次被控告抄袭“道道通”的凯立德地图中，《362城市》的内容是在《335城市》的版本上进行增加和更新。有知识产权专家称，在涉嫌抄袭的产品基础上进行改装、升级的产品，同样也涉嫌侵权，因此导航仪硬件厂商、经销商应当对这类改头换面的《×××城市》保持警惕。</FONT></P>
